Klauzula Informacyjna

W związku z realizacją wymogów Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. (RODO), pragniemy Państwa poinformować o następujących zasadach przetwarzania danych osobowych:

ADO przetwarza Państwa dane w celu:

1. Rekrutacji i zatrudnienia do naszej firmy
Podstawa prawna: Art. 6 ust. 1 lit b RODO, art. 22(1) Kodeksu pracy. Państwa dane osobowe wskazane w art. 22(1) Kodeksu pracy przetwarzamy w oparciu o w/w przepis. Podanie tych danych jest wymogiem ustawowym i niezbędnym do realizacji celu rekrutacji. Jesteście Państwo zobowiązani do ich podania, a konsekwencją niepodania będzie brak możliwości wzięcia udziału w rekrutacji. Pozostałe dane osobowe (np. wizerunek, zainteresowania) przetwarzamy na podstawie Państwa dobrowolnej zgody i ich podanie nie ma wpływu na możliwość udziału w rekrutacji.
Okres przechowywania danych osobowych: Państwa dane osobowe przetwarzamy w celu prowadzenia rekrutacji na stanowisko wskazane w ogłoszeniu przez okres trwania rekrutacji, a gdy wyrazili Państwo zgodę na udział w przyszłych rekrutacjach przez okres 1 roku od daty nadesłania dokumentów aplikacyjnych. Dane kadrowe oraz BHP zgodnie z aktualnie obowiązującymi przepisami.  

2. Współpracy z firmami zewnętrznymi z którymi ADO ma podpisaną umowę na świadczenie usług.Podstawa prawna przetwarzania: Art. 6 ust. 1 lit b RODO, podanie danych jest niezbędne w celu współpracy.
Okres przechowywania danych osobowych: przez okres niezbędny do realizacji zawartych umów i zasad w nich określonych. Minimum 5 lat od końca roku, w którym wystawiono ostatnią fakturę/dowód księgowy.

3. Prowadzenia działań marketingowych związanych z prowadzoną działalnością.
Podstawa prawna przetwarzania:
 Art. 6 ust. 1 lit a RODO oraz art. 6 ust. 1 lit f RODO. Podanie danych jest dobrowolne
Okres przechowywania danych osobowych: Dane marketingowe – do momentu wniesienia żądania usunięcia danych osobowych przez podmiot danych.

4. Sprzedaży usług oferowanych przez ADO.
Podstawa prawna przetwarzania:Art. 6 ust. 1 lit b RODO.
Okres przechowywania danych osobowych:przez okres niezbędny do realizacji zawartych umów i zasad w nich określonych. Minimum 5 lat od końca roku, w którym wystawiono ostatnią fakturę/dowód księgowy.

5. Przyszłe dochodzenia roszczeń.
Podstawa prawna przetwarzania: 
Art. 6 ust. 1 lit f RODO.
Okres przechowywania danych osobowych: Dane klientów w przypadku dochodzenia ewentualnych roszczeń, przez okres 6 lat od daty zawarcia umowy kupna – sprzedaży bądź też ostatniego kontaktu z klientem.

6. Ochrona mienia i pracowników oraz cele statystyczne.
Źródło pochodzenia danych: Dane pochodzące z monitoringu floty pojazdów poprzez GPS
Podstawa prawna przetwarzania: Art. 6 ust. 1 lit f RODO.
Okres przechowywania danych osobowych: Maksymalnie 36 miesięcy.

7. Obsługa reklamacji/zapytań konsumenckich
Podstawa prawna przetwarzania:
 art. 6 ust.1 lit. c RODO oraz art. 6 ust. 1 lit. f RODO
Okres przechowywania danych osobowych: Państwa dane osobowe będą przechowywane przez okres związany z reklamacją produktów, później przez okres przedawnienia roszczeń, nie dłużej niż 6 lat.

W przypadku pojawienia się innego celu niż wymieniony powyżej obowiązek informacyjny zostanie Państwu przekazany bezpośrednio w formularzu lub podczas pierwszej czynności skierowanej do Państwa.

Prawa związane z przetwarzaniem danych osobowych:

Jeżeli podstawą prawną jest art. 6 ust. 1 lit a lub b RODO: 

  • prawo dostępu do treści danych 
  • prawo do sprostowania danych 
  • prawo do usunięcia danych (prawo do bycia zapomnianym) 
  • prawo do ograniczenia przetwarzania danych 
  • prawo do przenoszenia danych 

Jeżeli podstawią prawną jest art. 6 ust. 1 lit. c RODO: 

  • prawo dostępu do treści danych 
  • prawo do sprostowania danych 
  • prawo do ograniczenia przetwarzania danych 

Jeżeli podstawą prawną jest art. 6 ust. 1 lit e lub f RODO: 

  • prawo dostępu do treści danych 
  • prawo do sprostowania danych 
  • prawo do usunięcia danych (prawo do bycia zapomnianym) 
  • prawo do ograniczenia przetwarzania danych 
  • prawo do sprzeciwu wobec przetwarzania danych 

Prawo do cofnięcia zgody: 

Jeżeli przetwarzanie odbywa się, na podstawie Państwa zgody (art. 6 ust. 1 lit. a RODO) dane będziemy przetwarzać do momentu jej wycofania. Zgodę można wycofać w każdej chwili, przesyłając wiadomość e-mail na adres wskazany powyżej lub osobiście w siedzibie Administratora.  Cofnięcie zgody nie ma wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem.   

Prawo wniesienia skargi do organu nadzorczego: 

Jeśli dopatrzą się Państwo naruszeń ze strony ADO, co do bezpieczeństwa przetwarzania tych danych, istnieje możliwość wniesienia skargi do organu nadzorczego zajmującego się ochroną danych osobowych, tj. do Prezesa Urzędu Ochrony Danych Osobowych. Aktualny adres organu nadzorczego to: Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa. 

Bezpieczeństwo danych:

Państwa dane osobowe będą przetwarzane, zgodnie z postanowieniami RODO, na piśmie lub w formie elektronicznej, w celach podanych powyżej oraz przy wykorzystaniu odpowiednich metod, służących zagwarantowaniu bezpieczeństwa i poufności danych osobowych zgodnie z art. 32 RODO. Współpraca pomiędzy naszą firmą, a podmiotami biznesowymi jest regulowana przez odpowiednie przepisy prawa.

Odbiorcy danych:

W związku z przetwarzaniem danych, Państwa dane osobowe mogą być udostępniane innym odbiorcom lub kategoriom odbiorców, takim jak:   

  • Właściwym podmiotom administracji publicznej i samorządowej w zakresie i w celach, które wynikają z przepisów powszechnie obowiązującego prawa. 
  • Firmom świadczącym usługi na rzecz ADO, a w szczególności w zakresie: ochrony danych osobowych, podmiotom wykonującym usługi audytu, obsługi informatycznej, oprogramowania komputerowego, finansowe, ubezpieczenia, serwisu urządzeń, korespondencyjne.
  • Innym podmiotom, które na podstawie stosownych umów przetwarzają dane osobowe dla administratora. 

Państwa dane nie będą przetwarzane w sposób zautomatyzowany w tym również w formie profilowania. Państwa dane nie są przetwarzane poza obszarem EOG.

In connection with the implementation of the requirements of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 (GDPR), we would like to inform you of the following rules for the processing of personal data:

PDC processes your data for the following reasons:

1. Recruitment and employment for our company
Legal basis:
 Art. 6 para. 1 letter b of the GDPR and Art. 22(1) of the Labour Code. Your personal data indicated in Art. 22(1) of the Labour Code is processed based on the above providing this data is a statutory and necessary requirement to achieve the purpose of recruitment. You are required to provide the data, and the consequence of not submitting it will be the inability to participate in recruitment. We process other personal data (e.g. images, interests) based on your voluntary consent, and providing it does not affect the possibility of participating in recruitment.
Period of personal data storage: We process your personal data for the purpose of recruitment for the position indicated in the advertisement for the duration of recruitment, and when you have agreed to participate in future recruitment, for a period of 1 year from the date of sending the application documents. HR and health and safety data is stored in accordance with current regulations.

2. Cooperation with external companies with which PDC has signed a contract for the provision of services.
Legal basis for processing:
 Art. 6 para. 1 letter b of the GDPR, under which providing data is necessary for cooperation.
Period of storage of personal data: for the period necessary to implement the concluded contracts and the principles set out therein. A minimum of 5 years from the end of the year in which the last invoice / accounting document was issued.

3. Conducting marketing activities related to the business.
Legal basis for processing:
 Art. 6 para. 1 letter a of the GDPR and Art. 6 para. 1 letter f of the GDPR. Providing data is voluntary.
Period of storage of personal data: Marketing data - until the data subject requests to delete personal data.

4. Sales of services offered by PDC.
Legal basis for processing:
 Art. 6 para. 1 letter b of the GDPR.
Period of storage of personal data: for the period necessary to implement the concluded contracts and the principles set out therein. A minimum of 5 years from the end of the year in which the last invoice / accounting document was issued.

5. Future redress.
Legal basis for processing:
 Art. 6 para. 1 letter f of the GDPR.
Period of storage of personal data: Customer data in the event of any possible claims, for a period of 6 years from the date of the purchase contract, sale or last contact with the customer.

6. Protection of property and employees as well as statistical purposes.
Source of data: Data from vehicle fleet monitoring via GPS.
Legal basis for processing: Art. 6 para. 1 letter f of the GDPR.
Period of storage of personal data: Maximum 36 months.

7. Handling consumer complaints / inquiries
Legal basis for processing:
 Art. 6 para.1 letter c of the GDPR and Art. 6 para. 1 letter f of the GDPR.
Period of storage of personal data: Your personal data will be stored for a period related to the complaint, longer for the period of limitation of claims, but no longer than 6 years.
In the event of a purpose other than those mentioned above, the information obligation will be provided to you directly in the form of or during the first activity directed to you.

Rights related to the processing of personal data:

If the legal basis is Art. 6 para. 1 letter a or b of the GDPR: 

  • the right to request access to your personal data 
  • right to rectification 
  • right to request for the data to be deleted (the right to be forgotten) 
  • right to restrict data processing 
  • right to transfer data 

If the legal basis is Art. 6 para. 1 letter c of the GDPR: 

  • the right to request access to your personal data 
  • right to rectification 
  • right to restrict data processing 

If the legal basis is Art. 6 para. 1 letter e or f of the GDPR: 

  • the right to request access to your personal data 
  • right to rectification 
  • right to request for the data to be deleted (the right to be forgotten) 
  • right to restrict data processing 
  • right to object to data processing 

The right to withdraw consent:

If the processing is based on your consent (Art. 6 para. 1 letter a of the GDPR), we will process data until it is withdrawn. Consent may be withdrawn at any time by sending an e-mail to the address indicated above or in person at the Controller's office.  The withdrawal of the consent does not affect the lawfulness of the processing that was made on the basis of such consent before its withdrawal.   

Right to lodge a complaint with a supervisory authority:

If you find any breaches on the part of PDC as to the security of processing this data, you can file a complaint to the supervisory body dealing with personal data protection, i.e. to the President of the Office for Personal Data Protection. The current address of the supervisory body is the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warszawa. 

Data safety:

Your personal data will be processed, in accordance with the provisions of the GDPR, in writing or in electronic form, for the purposes set out above and using appropriate methods to guarantee the security and confidentiality of personal data in accordance with Art. 32 of the GDPR. Cooperation between our company and business entities is governed by the relevant law.

Data recipients:

In connection with data processing, your personal data may be shared with other recipients or categories of recipients, such as:

  • Relevant entities of public and local administration in the scope and purpose that results from the provisions of generally applicable law. 
  • Companies providing services to PDC, in particular in the field of personal data protection, entities providing audit services, IT services, computer software, financial, insurance, equipment service, and correspondence.
  • Other entities that process personal data for the controller based on relevant contracts. 

Your data will be not be processed in an automated way, including in the form of profiling. Your data is not processed outside the EEA.
